1. Operator and Definitions


This website is operated by LG Electronics SA (Pty) Ltd ("LG"), with its principal place of business at LG House, 181 Barbara Road, Elandsfontein, Johannesburg, Gauteng, republic of South Africa, 1405.


'Points' means a cyber money for LG MOBILE service which are obtainable from the Website through registration subject to the approval of LG and the acceptance of the Terms by the User, logging into the Website and promotions. These can be used to obtain the Services for LG mobile phones.

'Services' means any functions, facilities, information, promotions or other services available through this Website relating to LG mobile phones including downloading of ringtones, images, games, screensavers and wallpapers as well as other products for mobile phones; transmission of SMS text messages or Emoticon messages and general news and information.

'Terms' means these terms and conditions, LG¡?s privacy policy and any other rules which may be posted on the Website. 'User' means any person resident in the Singapore who accesses or uses the Website with LG¡?s authorisation after registering on the Singapore section of the Website.

'Website' means the LG MOBILE Website and WAP site (lgmobile.com, LG Mobile.co.za, za.lgmobile.com).



2. Use of Website


2.1. Authorised access to the services requires registration on the website subject to acknowledgement and acceptance of these terms. Some of the services may be subject to additional conditions, which the user will be directed to. Once the user selects a username and password and LG accepts the registration, they may log into the services of the website using that username and password. By logging onto, and making use of, the website, users accept these terms and conditions.


2.2. Points obtained can be used to implement the services dependent upon the number of points required to use that particular service. Points are only available to users who register on the website.


2.3. LG may make improvements or changes to the website or services and/or any other website content including these terms and conditions at any time with or without notice. Users who access the website after these changes have been made are bound by such changes. LG may cease the existence of this website at any time.


2.4. Although the services currently offered by LG Mobile are for free and require no payment, the services may be changed to a paid service in the future. Users shall be given prior notification before any such change is adopted. Users shall at any time have the right to unsubscribe to the services of LG Mobile.


2.5. The download of content will be at no consideration but customers will be liable for all costs levied by their network operators including, without limitation, WAP and any related charges.


3. Duties of the user



3.1. The User undertakes to submit true, correct, current and complete information required for registration. If changes to this data occur, the User will inform the Webmaster immediately at the email address provided on the Website. If LG believes the information provided is not correct it retains the discretion to refuse the User from access to the Website.


3.2. User is responsible for maintaining the confidentiality of their username and password. Any unauthorised use must be reported to LG immediately.


3.3. Access to the Services is only authorised to the User. Access to the Website is not limited to registered users, however any unregistered Users must comply with these Terms and any applicable laws.


3.4. By using this Website through downloading, uploading or browsing the User agrees to not reproduce, transmit, modify, or republish any information for commercial use. Users may download or print one copy of any and all of the materials for personal and lawful use provided they do not alter, modify, change, or delete any of the materials and intellectual property rights that may subsist.


3.5. User agrees to be solely responsible for all material that is uploaded onto the Website including certifying that they own all intellectual property rights in their contents. LG retains the discretion to prohibit uploading of any information (including choice of username) that it sees as inappropriate or any material that could conflict with applicable laws. LG retains the right to delete such material and terminate Users access to relevant Website content without notice or reason.


3.6. User agrees to indemnify LG and its group companies and all of our officers, directors, owners, employees, agents, information providers, affiliates, partners and licensors harmless from and against any and all liability, losses, costs and expenses (including legal fees) incurred by LG in connection with any claim by a third party arising from your usage of the Website and any breach of these Terms.


4. Intellectual Property Rights


LG retains full rights to all intellectual property rights on products (patents, trademarks, copyrights, design rights, know-how and processes), services and content of website. all trademarks, service marks and trade names, which appear on our website, are legally registered or common law trademarks and service marks of their respective owners and each such trademarks, service mark or trade name may be used only with prior written consent from LG.


5. Data Protection


5.1. The personal data provided by the user will be processed by LG to be able to carry out the services offered through website and to keep the user informed about other similar products and services of LG. if the user no longer wishes to be kept up to date about the services and products of LG, the user can indicate this wish to LG in the following manner:

5.2. LG does not transfer personal data for marketing purposes. Personal data shall solely be transferred in the interest of carrying out the services provided by LG Mobile as well as the technical maintenance of the website. for these purposes, personal data may be transferred to other LG group companies and third parties, but shall at all times remain under the strict control of LG. in this context, personal data may be accessed in other eu countries and in the republic of south Korea. By accepting the present terms and conditions, the user shall acknowledge and consent to the transfer of personal data for the said purposes.


5.3. LG shall adopt all security measures that may be reasonably required in accordance with the state of technology and the conditions in the market, in order to protect the information provided against any infectious code or virus and unauthorised access.


5.4. Cookies may be sent to the computer to help recognise the user upon sign in. this will allow the user to log onto the website without having to provide registration details again. Cookies shall not be used to process personal data other than for this purpose of convenience. it is possible for the user to set the web browser to notify the user when receiving a cookie.


5.5. Further to article 2.4, if the services of LG Mobile become a paid service, users will not have to register again. Their existing data shall then be further used strictly for the purpose of billing. 6. Applicable law


These terms shall in all respect be governed and construed in accordance with the laws of the Republic of South Africa.


7. Disclaimer


7.1. LG does not accept responsibility for any information present on the Website that may not be complete, true and/or accurate. LG does not accept any direct, indirect or consequential liability for any inaccuracies or typographical errors that may occur. Any reliance on any such information shall be at one's own risk. Any damage to computer system or loss of data that results from the downloading of any information is subject to the discretion of the User and risk. LG cannot guarantee the Website running uninterrupted and error free.


7.2. The Website, the information and materials on the Website, and the software made available on the Website, are provided "As Is" without any representation or warranty, express or implied, of any kind, including, but not limited to, warranties of merchantability, non-infringement, or fitness for any particular purpose.
